Temporary Employment Based Visas (employment visas, visitor’s visas, student visas)

There are several different types of temporary visas that individuals may obtain to visit or stay in the United States. Your eligibility or the eligibility of a prospective worker for a temporary visa depends on several factors, including education, work experience and the intentions of the individual. Certain temporary visa categories allow for the spouse and the children of the individual to obtain a temporary visa.

Employment-Based Lawful Permanent Residency---“Green Card”

The process whereby an individual may obtain a green card through a qualified U.S. employer can be both lengthy and stressful. Therefore, its essential that you obtain a qualified immigration attorney who can help you to navigate you through the process.  There are numerous ways whereby an individual can obtain a green card through his or her employer. Below are just some of the categories:

Workers with Advanced Degrees or Exceptional Ability in the Sciences, Arts or Business (EB-2)

Individuals, who can demonstrate that they have earned an advanced degree, or have an exceptionalability may qualify for this category. This category requires that an individual also have a potential employer, who must complete the Alien Labor Certification (ALC) process. ALC process requires that the individual show that he or she has the qualifications for the job and the employer must demonstrate that there are no qualified U.S. workers for the position. In certain cases, an individual can show that his or her entry is in the national interest, and may obtain a waiver of the job offer and ALC requirements.

Skilled Workers and Professionals (EB-3)

Qualified individuals must have a have a job offer and the potential employer must complete the ALC process. The employer must show that the position requires a college degree, or at least two years of experience related to the position offered.

Investor/Employment Creation Visas (EB-5)

There are two groups of investors that may fall under this visa category. The first group is an individual who invests at least $500,000 in "targeted employment areas" (rural areas or areas experiencing high unemployment). The second group is an individual who invests significant amount of funds in a U.S. business.

Family-Based Lawful Permanent Residency

Family members of U.S. Citizens and green card holders who wish to immigrate permanently to the U.S. may apply for a green card based on their family relationship. In order to eligible under this category, an individual must show there is a qualifying family relationship.


Naturalization is the process by which U.S. citizenship is given to those who were not born in U.S. territory. In order to become a naturalized U.S. citizen, an individual must meet certain qualifications.
